All copyright and other intellectual property rights subsisting in this website, the contents of this website and the information on this website are owned or licensed by Sam Jackson.

'Artwork' means paintings of any medium, drawings, images, works on canvas or paper, digital works, or any other art that may be purchased through our website.

GENERAL ARTWORK DISPLAY DISCLAIMER

While we make every effort to ensure that images and descriptions of our Artworks are presented as accurately as possible, variations may occur. Actual Artworks may differ slightly in colour, shading, lighting, medium, and size.

Please note that the colours displayed on your screen or device may not precisely match the colours of the physical Artwork. This is due to differences in screen settings, monitor capabilities, and individual visual perception. As such, we cannot guarantee that the colours you see on your screen will be an exact representation of the Artwork. Accordingly, colour variation alone is not considered a fault.

When ordering prints, clients may choose from a range of sizes and materials, including different types of paper or canvas. Please note that such selections can affect the appearance of the final product. Variations in colour, texture, sharpness, and overall finish may occur depending on the chosen size or medium. These differences are a normal result of the printing process and materials used and are not considered faults or defects.

If you have specific concerns, questions, or requirements regarding colour, size, design, or any other aspect of the Artwork, we strongly encourage you to contact us prior to making a purchase so we can assist you wherever possible.

COPYRIGHT AND LICENCE FOR PURCHASE

Ownership of the physical Artwork transfers to the purchaser upon full payment. However, the Artist retains full ownership of all copyright and associated intellectual property rights in the Artwork at all times. The purchase of an Artwork does not transfer copyright or intellectual property rights.

Licence Granted to the Purchaser

Upon full payment, the purchaser receives a permanent, non-exclusive, non-transferable, royalty-free licence to:

  • display the Artwork in their home or business; and

  • gift the physical Artwork to another person.

No other rights are granted.

If an Artwork is returned, replaced, or refunded for any reason, this licence automatically terminates and all rights revert to the Artist.

Restrictions

Unless the Artist provides express written permission, the purchaser must not:

  • copy, reproduce, scan, photograph for reproduction, or otherwise duplicate the Artwork;

  • create prints, merchandise, digital files, or any commercial products featuring the Artwork;

  • modify, adapt, edit, or create derivative works based on the Artwork;

  • sell, licence, or distribute any reproduction or digital version of the Artwork.

Commercial or Reproduction Rights

If you wish to reproduce the Artwork in any form or obtain commercial rights, please contact the Artist, Sam Jackson, to discuss licensing options.

PROPRIETARY RIGHTS

Whether or not you purchase Artwork, all intellectual property rights in the Artwork and all other Content on this website remain the exclusive property of the Artist.

The purchase of an Artwork does not restrict the Artist from continuing to use the Artwork in any way, including (but not limited to) creating and selling prints or reproductions, displaying the Artwork publicly, or licensing the Artwork to third parties.

You are strictly prohibited from downloading, reproducing, replicating, or otherwise copying any Artwork or Content from this website without prior written permission, except where expressly permitted under this policy.
